Merchant Customer Data Use Policy

1. Permitted use

Merchants may use customer information received through Waly Market only to fulfill orders, communicate about active or recent orders, provide legitimate customer service, comply with law, prevent fraud, and perform other purposes expressly authorized by Waly Market and applicable law.

2. Prohibited use

Merchants may not sell customer information, use it for unauthorized advertising, add customers to unrelated marketing lists without required consent, disclose it to unrelated third parties, harass customers, or retain it longer than reasonably necessary for permitted purposes.

3. NYC restaurant data

Customer information provided to NYC restaurants under applicable NYC delivery-platform rules remains subject to applicable law and this Policy. A restaurant must respect valid customer opt-out choices and any restrictions governing use of the information.

4. Security

Merchants must use reasonable safeguards to protect customer information and restrict access to personnel who need the information for legitimate business purposes.

5. Incidents

A merchant must promptly notify Waly Market of suspected unauthorized access, disclosure, loss, or misuse involving Waly Market customer information and cooperate with reasonable investigation and remediation steps.
