1. Independent contractor relationship
A driver who uses Waly Driver provides delivery services as an independent contractor and not as an employee of Waly Market, subject to applicable law. The driver is responsible for taxes, expenses, equipment, and business obligations that properly apply to an independent contractor. This Agreement does not waive rights that cannot lawfully be waived.
2. Eligibility
Drivers must satisfy Waly Market eligibility requirements, provide accurate onboarding information, maintain required documents, and comply with applicable licensing, registration, insurance, and legal requirements.
3. Freedom to accept or reject offers
Drivers may choose whether to make themselves available and, subject to applicable product rules and law, whether to accept or reject delivery offers. NYC-specific delivery preferences and anti-retaliation protections apply where required.
4. Delivery standards
Drivers must safely pick up and deliver orders, protect customer and merchant property, follow lawful instructions, maintain food and product integrity, avoid tampering, and use proof-of-delivery tools honestly.
5. Vehicle requirements
Waly Market permits approved car, bicycle, and motorcycle delivery subject to applicable requirements. Drivers may not use an unapproved vehicle type or misrepresent the vehicle used.
6. Pay and tips
Driver compensation is described in applicable offer screens, earnings records, payment policies, and jurisdiction-specific notices. Waly Market provides drivers 100% of customer tips designated for them. Tips do not count toward minimum compensation where law prohibits that treatment.
7. Expenses
Unless Waly Market expressly agrees otherwise or law requires otherwise, drivers are responsible for their ordinary operating expenses, including fuel, vehicle maintenance, mobile service, and equipment.
8. Location and data
Drivers authorize Waly Market to collect and use location and delivery activity information as described in the Driver Privacy and Location Notice and applicable device permissions. Location may be necessary while a driver is available for offers or completing deliveries.
9. Customer and merchant information
Drivers may use customer and merchant information only as necessary to perform delivery services and may not retain, disclose, sell, or use it for unrelated purposes.
10. Account security
Drivers may not share accounts, permit another person to deliver under their identity, falsify identity or documents, or manipulate the Waly Driver system.
11. Safety and law
Drivers must follow traffic, vehicle, parking, food-handling, privacy, anti-harassment, and other laws applicable to their work and must not perform deliveries while impaired.
12. Suspension and deactivation
Waly Market may investigate, restrict, suspend, or deactivate accounts for legitimate safety, fraud, identity, legal, documentation, or policy reasons, subject to applicable anti-retaliation requirements and the Driver Deactivation and Appeals Policy.
13. Records and cooperation
Drivers must provide accurate information reasonably necessary for payment, tax, safety, insurance, licensing, background screening where applicable, and regulatory compliance.
14. Changes and contact
Waly Market may update this Agreement prospectively as permitted by law. Driver questions may be sent to help@walymarket.com.
