1. Current minimum rate
For pay periods beginning on or after April 1, 2026, the NYC minimum pay rate for covered restaurant and grocery delivery workers is $22.13 per hour, excluding tips. The rate is adjusted annually by NYC.
2. Standard Method
Under the Standard Method, Waly Market must ensure each worker receives at least the applicable minimum pay rate multiplied by that worker's covered trip time during the pay period. Waly Market must also satisfy the applicable aggregate compensation requirement for covered trip time and on-call time as required by NYC rules.
3. Alternative Method
Where legally available and selected for a pay period, the Alternative Method requires individual compensation of at least the applicable minimum pay rate divided by 60%, multiplied by the worker's covered trip time. Eligibility to use this method depends on NYC utilization rules and limited exceptions.
4. Trip time
Covered trip time begins when a worker accepts an offer or receives an assignment for a covered trip and includes applicable selecting, preparing, assembling, waiting, pickup, and travel time until the trip is completed or canceled.
5. On-call time
On-call time is time when a worker is connected to the Waly Driver system in a status where the worker can receive or accept offers for trips with a pickup or drop-off location in New York City, excluding trip time.
6. Method disclosure
Waly Market may use the method permitted by NYC law for the applicable pay period. The method actually used will be identified on the driver's written pay statement as required.
7. Tips
Customer tips are not counted toward Waly Market's NYC minimum-pay obligation.
8. Rate changes
Because NYC adjusts the minimum rate and may update rules, Waly Market will apply the legally effective rate and calculation requirements for each covered pay period.
